♦ Mediation & Arbitration
Arbitration is a formal process where the parties to a dispute present their sworn evidence and arguments to an arbitrator, who then makes a final, binding decision in writing with reasons. This process often involves a winner and a loser, as the arbitrator imposes a solution. While arbitration offers resolution, it is inherently uncertain in terms of outcome, time, and the cost of litigation.
Mediation, on the other hand, offers a more flexible and collaborative approach. In mediation, I assist the parties in negotiating their own resolution. Rather than focusing solely on strict legal rights, mediation allows the parties to explore their underlying interests and craft a solution that works for both sides. Mediation empowers the parties to retain control over their settlement, ensuring a more cost-effective and often less adversarial process. Furthermore, mediation is less likely to damage ongoing relationships between the parties, as it encourages mutual understanding and cooperation.
